TERMS AND CONDITIONS OF HARD ROCK HOTEL & CASINO OTTAWA

DEFINITIONS

In these Terms and Conditions, "we" or "us" refers to Hard Rock Hotel & Casino Ottawa (the "Casino") which is operated by HR Ottawa LP ("Operator"), a service provider partnered with Rideau Carleton Raceway Holdings and Hard Rock International. The Operator also acts as the operator for the gaming bundle owned by OLG.

ACCEPTANCE OF TERMS AND CONDITIONS

By participating in any activity at the Casino, including but not limited to gaming, dining, entertainment, or accommodations provided through our hotel operations, you agree to be bound by these Terms and Conditions ("Agreement"). You acknowledge that your use of the facilities at the Casino shall be governed by applicable laws and regulations as administered and enforced by OLG under the Alcohol and Gaming Regulation Act 1993 (AGRA) as amended, including but not limited to Regulations made thereunder.

ELIGIBILITY

The Casino is open to eligible guests from Canada and abroad who travel to the property provided they meet age and identification requirements as set out in section 7 of AGRA. Eligibility will be determined by us at our absolute discretion with no liability whatsoever arising for any failure or decision in this regard.

RESPONSIBLE GAMBLING

It is your responsibility to gamble responsibly, and we urge you to be aware of the risks associated with problem gambling. We reserve the right to restrict access to certain games or services if necessary. It may also affect how quickly you can withdraw funds from your casino account. You must not gamble when inebriated.

GAMING RULES

The rules for gaming at the Casino are governed by applicable laws and regulations including AGRA, its Regulations made thereunder, and any policies published or otherwise adopted by OLG to promote responsible gambling practices. We may revise these terms from time to time as necessary to comply with such legislation; we will endeavour to give reasonable notice of changes.

PERSONAL AND FINANCIAL INFORMATION

You agree that we are entitled (but not obligated) to share personal and financial information you have provided us, including any credit card or bank account details ("Personal Information") to the OLG as necessary for regulatory purposes. Personal Information may also be collected by other third parties under separate privacy policies.

DATA PROTECTION AND COOKIE POLICY

We may collect non-personal data about users (e.g., browser type, pages visited) in order to improve website functionality and services offered on our websites or apps ("Non-Personal Data"). If Non-Personal Data is collected from you directly, it will be treated as Personal Information for the purposes of this Agreement. By using our products, including mobile applications (collectively referred to as "Apps"), you are accepting these data protection policies which we reserve the right to modify or update in line with legislative changes without prior notice.

GAMING AND ENTERTAINMENT SERVICES

When gaming at the Casino, please follow standard casino rules and be aware that betting limits apply. Please gamble responsibly, set spending budgets before starting your session, keep track of losses so they do not exceed 20% of initial budget; if necessary take time-outs (temporary leave), self-exclusion or ask assistance from one of our employees.

MATERIALS PROVIDED ON WEBSITE

All materials provided on the website including text, images and graphics are protected under applicable copyright laws. Reproduction without prior permission is strictly prohibited unless for private use only. We do not guarantee that links to external sites will be available at all times; their content is subject to change.

EXTERNAL LINKS

When accessing any other websites through hyperlinks on the website, we have no control over how third parties collect data or display information about users, therefore our liability regarding these issues are limited by applicable laws and regulations as administered under OLG in Canada. In case an online platform links to one of ours, users may also be subject to such terms and conditions, which will prevail upon these where there is inconsistency.

EXCLUSION OF WARRANTIES

We provide no warranty that this Agreement or the information contained herein does not infringe any third party's intellectual property rights nor imply they are liable for any error or omission in materials published by us as part of our marketing efforts; we cannot warrant access to products, services or facilities at all times and exclude liability arising therefrom.

GOVERNING LAW

These Terms and Conditions will be governed exclusively according to the laws of Canada without regard to its conflict of law rules that might require application of the laws of another jurisdiction where such is not specified within a separate document (if any). Each party consents to submit itself irrevocably, for all purposes including dispute resolution procedures under section 19 of AGRA, to non-exclusive personal jurisdiction and venue in the Courts located within Ontario.

VARIATION

We can change these Terms and Conditions by giving reasonable notice or as allowed for in applicable law(s). Continued use after such changes takes effect indicates that you agree with them. We also have rights which cannot be varied or waived, but we may make exceptions from time to time where there is an overriding public interest.

FORCE MAJEURE

We accept no liability arising due to acts of God, natural disasters, war (including terrorism), insurrections, civil unrest, unforeseen government action, communication breakdowns and technical problems which have arisen beyond our control; by providing access here you agree that such causes prevent obligations between parties from being fulfilled in good faith.

SEVERABILITY

In case any term or provision within these Terms is held to be invalid, this shall not affect the remainder of this Agreement as far as possible with due regard given toward applicable laws and regulations where there was no stipulation in respect of which an agreement may have failed for want thereof.

GOVERNMENTAL REGULATIONS

The Casino must comply with all relevant government regulations including those administered by OLG; failure to do so will give us the right to cease access or modify these Terms & Conditions without prior notice if necessary to maintain compliance.

DISPUTE RESOLUTION PROCESS

For any dispute arising from the interpretation, construction, validity, performance and execution of this Agreement as governed exclusively under applicable laws in Canada should such arise it must be addressed using alternative dispute resolution mechanisms (e.g., arbitration).

CONFIDENTIALITY AND SECURITY

We agree to treat Personal Information securely according to standards outlined within our data protection policies; all sensitive information shared with us shall only be used by authorized staff for purposes directly related to the services being provided at that time.

COMPLAINTS PROCEDURE

If there is a problem regarding use of this Agreement, please notify Customer Services department in writing via email or standard mail addressed as per address stated on our website; we endeavour to respond promptly but reserve right not answer certain requests if handling information would require us divulging proprietary information protected under Canadian copyright law.
